1. Who you are contracting with

These Terms form an agreement between you and scale-security LTD (trading as Dream Cloud) ("we", "us"), the provider of the Dream Cloud AI dream-journaling and analysis service (the "Service").

2. Acceptance

By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

3. Your account

You must provide accurate information, keep your credentials confidential, and be at least the age of majority in your jurisdiction. You are responsible for all activity under your account.

4. Acceptable use

You agree not to misuse the Service, including by:

  • using it for unlawful purposes, fraud, or spam;
  • infringing intellectual property or privacy rights of others;
  • uploading malware or attempting to interfere with the Service's security;
  • probing, scanning, or scraping the Service;
  • submitting content that is illegal, hateful, harassing, or sexually exploitative;
  • attempting to jailbreak the AI models or generate prohibited content.

5. AI outputs

Dream Cloud uses generative AI to produce dream analyses, narration, and imagery. Outputs may be inaccurate or incomplete and are provided for personal, reflective purposes only. They are not medical, psychological, legal or other professional advice. You are responsible for how you use them and for verifying any information on which you rely.

You retain rights to the dream content you submit. You grant Dream Cloud a limited licence to process that content to operate the Service. You are responsible for the prompts and content you submit and must have the rights to do so. We may remove content or suspend accounts for repeated infringement or policy violations and provide a takedown pathway via the contact address below.

6. Intellectual property

The Service, including its software, design, and branding, is owned by scale-security LTD and protected by applicable IP laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

7. Payments and subscriptions

Paid plans are billed in advance on a recurring basis until cancelled. Payment, billing, taxes, cancellations and refunds are handled by our Merchant of Record, Paddle. See the Paddle Buyer Terms and our Refund Policy for details.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Service availability

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify or discontinue features at any time.

9. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may cancel your subscription at any time through your account.

10. Warranty disclaimer

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, scale-security LTD's aggregate liability under these Terms is limited to the fees you paid in the twelve months preceding the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing limits liability that cannot be limited by law.

12. Governing law

These Terms are governed by the laws of the seller's jurisdiction. Disputes will be resolved in the competent courts of that jurisdiction unless mandatory consumer law provides otherwise.
